By accessing the website, creating an account, completing an assessment, purchasing a service, enrolling in a programme or otherwise using ASKZONE, you agree to these Terms. If you do not agree with these Terms, please do not use ASKZONE.

1. About ASKZONE

ASKZONE Wellness Pvt Ltd operates an AI-powered Human Capacity and Transformation platform.

ASKZONE may provide services to:

• • Entrepreneurs and working professionals
• • Consultants and other professionals
• • Corporate and organisational clients
• • Other users or entities approved by ASKZONE

Services may include:

Free human-capacity assessments; detailed assessments; AI-generated reports; Human Capacity Scores; personalised recommendations; Burnout Recovery Consultation; Capacity-building consultation; educational programmes; professional certification; corporate assessment and reporting; corporate consultation and development programmes; digital content and resources; and other services introduced by ASKZONE.

2. Acceptance of Terms

By using ASKZONE, you confirm that:

• • You agree to comply with them
• • You will provide accurate information
• • You will use the platform lawfully
• • You have authority to enter into these Terms where you are acting on behalf of an organisation

If you are using ASKZONE on behalf of a company or organisation, you represent that you have authority to bind that organisation.

3. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to purchase paid services.

Where a minor accesses ASKZONE, use of services requiring consent or payment must be undertaken with appropriate involvement of a parent or legal guardian where required by applicable law.

ASKZONE may restrict access where it reasonably believes that eligibility requirements have not been satisfied.

4. Account Registration

Certain ASKZONE services require an account.

You agree to provide accurate, complete and current information.

You are responsible for:

• • Maintaining the confidentiality of your login credentials
• • Preventing unauthorised access to your account
• • Updating inaccurate information
• • Not sharing your account except where expressly permitted
• • Notifying ASKZONE promptly if you suspect unauthorised access

ASKZONE may suspend an account where necessary for security, fraud prevention, legal compliance or violation of these Terms.

5. Free Assessment

ASKZONE may provide a free assessment for users to obtain preliminary insights into different dimensions of functioning and human capacity.

The free assessment:

• • May contain adaptive questions
• • May generate an automated summary
• • May generate an indicative score
• • May provide recommendations regarding further assessment or services
• • May change over time as ASKZONE updates its methodology

The free assessment is not a medical, psychiatric, psychological or clinical diagnostic examination.

6. Detailed Assessment

ASKZONE may offer a paid detailed assessment.

The detailed assessment may involve additional questions, analysis, scoring and personalised reporting.

The User understands that assessment results depend partly on the information supplied by the User.

Providing inaccurate, incomplete or deliberately misleading information may affect the usefulness of the results.

7. Human Capacity Score

ASKZONE may generate a proprietary Human Capacity Score or related indicators.

Such scores are analytical tools intended to support self-awareness, development planning and progress tracking.

A Human Capacity Score:

• • Does not measure human worth
• • Does not determine a person's potential
• • Is not a medical or psychological diagnosis
• • Is not necessarily comparable across different methodologies or versions
• • May change as a person's responses and circumstances change
• • Should not be treated as an absolute or permanent measurement

Corporate clients must not use ASKZONE scores as the sole basis for employment termination, disciplinary action, promotion, compensation, recruitment or other high-impact employment decisions.

8. AI and Automated Systems

ASKZONE may use artificial intelligence, machine learning, automated decision-support systems and other computational technologies.

AI-generated outputs may contain errors, omissions, inconsistencies or inappropriate recommendations.

Accordingly, users must exercise independent judgement.

ASKZONE does not represent that every AI-generated output will be accurate, complete, unbiased or appropriate for every user.

9. Consultation Services

ASKZONE may provide:

• • Burnout Recovery Consultation
• • Capacity Building Consultation
• • Individual consultation
• • Corporate consultation
• • Professional mentoring
• • Other consultation programmes

Consultation is intended to support reflection, learning, personal development, behavioural development and capacity building.

Consultation does not guarantee any particular result.

The User remains responsible for decisions and actions taken before, during or after consultation.

10. No Medical or Clinical Service

Unless expressly stated otherwise, ASKZONE is not a medical or healthcare provider.

ASKZONE assessments, consultation, reports and recommendations must not be treated as:

• • Medical diagnosis
• • Psychiatric diagnosis
• • Clinical psychological diagnosis
• • Medical treatment
• • Emergency care
• • A substitute for healthcare
• • A prescription
• • A replacement for professional medical or mental-health services

Users requiring professional healthcare should consult an appropriately qualified professional.

11. Professional Certification

ASKZONE may provide certification programmes including, but not limited to:

• • Consultant Certification
• • Burnout Recovery Consultant Certification
• • Capacity Consultant Certification
• • Corporate Consultant Certification
• • Senior Consultant Certification

Certification confirms completion of the applicable ASKZONE training and evaluation requirements.

ASKZONE training may align its curriculum and evaluation criteria with the ICF Code of Ethics and Core Competencies. ASKZONE programmes and certificates are not ICF-accredited, approved or endorsed and do not confer an ICF credential such as ACC, PCC or MCC.

Unless specifically recognised by applicable law, ASKZONE certification is not:

A government licence; a statutory professional qualification; a medical qualification; a psychological licence; a psychiatric licence; or a licence to practise any regulated profession.

Certified professionals remain responsible for complying with all laws and professional requirements applicable to their practice.

ASKZONE may suspend or revoke certification for serious misconduct, fraudulent representation, misuse of ASKZONE intellectual property or material violation of certification requirements, subject to applicable law.

12. Corporate Services

Corporate clients may purchase employee assessment, human-capacity analytics, consultation, organisational insights and related services.

Corporate customers are responsible for ensuring that their instructions concerning employee or worker data comply with applicable laws and employment requirements.

Where individual employee data is involved, the applicable data-processing arrangements may be governed by a separate corporate agreement.

13. Fees and Payments

Prices applicable to each service will be displayed on the website, checkout page, proposal, invoice or other applicable communication.

The User agrees to pay the applicable price before access is provided unless otherwise agreed.

Payments may be processed through third-party payment gateways.

ASKZONE does not store complete payment-card information unless expressly stated and lawfully permitted.

Applicable taxes may be charged in addition to displayed prices.

14. Digital Services

Some ASKZONE services are delivered digitally.

These may include:

The User must maintain a compatible device and internet connection unless otherwise stated.

15. Course and Programme Access

Paid courses and programmes are generally intended for the individual purchaser.

Users must not:

• • Distribute course material
• • Sell access
• • Upload proprietary course material publicly
• • Record sessions without permission
• • Reproduce ASKZONE training material
• • Create competing commercial training products using ASKZONE proprietary material

Access periods, where applicable, will be communicated for the relevant programme.

16. Intellectual Property

ASKZONE owns or has lawful rights to use its:

• • Assessment frameworks
• • Scoring systems
• • Methodologies
• • Reports
• • Course materials
• • Training materials
• • Videos
• • Graphics
• • Text
• • Designs
• • Interfaces
• • Other proprietary content

Use of ASKZONE does not transfer ownership of ASKZONE intellectual property to the User.

17. User Content

Users may submit responses, messages, feedback, assessment information and other content.

You remain responsible for information you submit.

You grant ASKZONE the limited rights necessary to host, store, process, analyse and display such information for providing the requested services, subject to the Privacy Policy and applicable law.

18. Prohibited Activities

You must not:

• • Hack or attempt to hack ASKZONE
• • Circumvent security controls
• • Introduce malware
• • Scrape proprietary data without permission
• • Reverse engineer ASKZONE systems except where legally permitted
• • Impersonate another person
• • Use another person's account
• • Submit fraudulent information
• • Abuse ASKZONE personnel or consultants
• • Infringe intellectual-property rights
• • Use ASKZONE for unlawful activities
• • Attempt to manipulate assessment results
• • Resell ASKZONE services without authorisation
• • Use ASKZONE outputs for prohibited high-impact decisions

19. Third-Party Services

ASKZONE may rely on third-party providers for:

• • AI infrastructure
• • Authentication
• • Email
• • SMS
• • Video conferencing
• • Voice communications
• • Analytics
• • Security
• • Customer support
• • Other infrastructure

Third-party services may have separate terms and privacy policies.

20. Website Availability

ASKZONE does not guarantee uninterrupted availability.

Temporary interruption may occur because of:

21. Refunds and Cancellation

Refunds and cancellations are governed by ASKZONE's separate Refund & Cancellation Policy, which forms part of these Terms.

Where a service has already commenced or digital content has been accessed, refund eligibility may be affected as specified in that policy and subject to applicable law.

22. Disclaimer of Warranties

To the maximum extent permitted by law, ASKZONE services are provided on an “as available” basis.

ASKZONE does not guarantee:

• • Revenue outcomes
• • Employment outcomes
• • Accuracy of every AI output
• • Continuous website availability
• • Suitability of every service for every user

Nothing in these Terms excludes a legal right or liability that cannot lawfully be excluded.

23. Limitation of Liability

To the maximum extent permitted by applicable law, ASKZONE shall not be liable for indirect, incidental, special, consequential or unforeseeable losses arising from use of the platform.

Where liability cannot legally be excluded, ASKZONE's liability will be limited to the extent permitted by applicable law.

Where legally permissible, the maximum aggregate liability for a specific paid service shall not exceed the amount actually paid for that service.

24. Indemnification

To the extent permitted by law, you agree to indemnify ASKZONE against claims arising from:

• • Your infringement of another person's rights

28. Privacy

Use of ASKZONE is also governed by the ASKZONE Privacy Policy.

The Privacy Policy explains how personal data is collected, used, stored, shared and protected.

29. Governing Law

These Terms are governed by the laws of India.

Subject to mandatory consumer and other statutory rights, disputes shall be subject to the jurisdiction of competent courts in West Bengal, India.

30. Dispute Resolution

Users should first contact ASKZONE to attempt good-faith resolution of any dispute.

Nothing prevents a consumer from exercising statutory rights available under applicable law.

31. Severability

If any provision is held invalid or unenforceable, the remaining provisions will continue in effect.

32. Entire Agreement

These Terms, Privacy Policy, Disclaimer, Refund & Cancellation Policy, and any applicable service-specific or corporate agreement constitute the agreement governing use of ASKZONE.
